Berkman Henoch Obtains Favorable Ruling on Behalf of the Town of Hempstead
Partner Donna A. Napolitano and associates, Daniel Evers and Kaitlyn Costello, successfully defended the Town on its summary judgment motion and defeated plaintiff’s cross motion for summary judgment in a decision issued by Senior District Judge Arthur D. Spatt. In her motion, the plaintiff alleged that she was deprived of due process when she was evicted. Judge Spatt denied her motion and granted the Town’s motion finding that plaintiff had no protected property interest and that the actions taken by the Town, under its emergency statute, were not an abuse of discretion.
